- User: Refers to the individual who works for the Client and who, alone or jointly with others, is authorized to manage the operation of the Client's land fleet through the digital platform www.fuelsoftwarecontrol.com and/or through the FSC mobile application.
- Holder: Refers to the natural person to whom the personal data belongs.
- Consent: Free, specific, and informed expression of the Holder's will through which the processing of their data is carried out.
- Personal Data: Any information concerning an identified or identifiable person. A person is considered identifiable when their identity can be determined directly or indirectly through any information.
- Sensitive Personal Data: Personal data that affects the most intimate sphere of the Holder, or whose improper use may give rise to discrimination or entail a serious risk for them.
- Database: The ordered set of personal data referring to an identified or identifiable person, subject to certain criteria, regardless of the form or modality of its creation, type of medium, processing, storage and organization.
- A.R.C.O. Rights: Refers to the Holder or their legal representative who may request from Gasmonsoft at any time Access, Rectification, Cancellation, or Opposition with respect to the Personal Data that concerns them.
- Ministry: Anti-Corruption and Good Governance Ministry.
II. Responsible party
GASMONSOFT, S.A. DE C.V., with address at Carrera panamericana No. 5831. Col. Plan de Ayala, Tuxtla Gutiérrez, Chiapas, México, C.P. 29020, hereinafter referred to as "GASMONSOFT", in compliance with the Federal Law on Protection of Personal Data Held by Private Parties and its regulations, informs you that it is responsible for collecting your "personal data", for the use given to it, and for its protection, in order to prevent unauthorized processing, as well as any alteration, destruction, or damage to your "personal data".
III. Personal data collected by Gasmonsoft
The "personal data" you provide to "GASMONSOFT" through its offices, corporate emails, digital platform www.fuelsoftwarecontrol.com, "FSC" mobile application, or by phone, through the completion of physical or electronic forms; "GASMONSOFT" complies with all requirements and principles stipulated by the Federal Law on Protection of Personal Data Held by Private Parties and its respective regulations.
In turn, your registration as a "user" through our digital platform www.fuelsoftwarecontrol.com and/or mobile application "FSC", to request a quote or information about our products and/or services, is done freely, voluntarily, and individually.
The data that "GASMONSOFT" collects and obtains from its "clients" and/or "users" are the following:

"GASMONSOFT" may require its "clients" to provide the Tax Status Certificate and/or any document requested by the Tax Administration Service (S.A.T.) in order to issue an invoice in favor of the "client".
To obtain the "sensitive personal data" mentioned above, "GASMONSOFT" obtains the express "consent" of the "holder", as established in article 8 of the Federal Law on Protection of Personal Data Held by Private Parties.
Additionally, to hire our technical-professional services we may require other information or documentation not specified in this privacy notice; however, to obtain such information or documentation, your prior "consent" will be requested.

Additionally, if "GASMONSOFT" personnel contact the "user" to follow up on the requested quote, supplementary information or documentation may be requested for the service contracting process.
"GASMONSOFT" collects necessary information or documentation to verify and confirm your identity as a "client" and/or "user", as well as to perform its technical-professional services.
"GASMONSOFT" may process personal data of third parties (as representative, attorney, shareholder, or employee) when you provide us with their information to fulfill our obligations arising from the contracting of the product or service. In these cases, you acknowledge having informed such third parties about the use of their data and having previously obtained their consent.
Likewise, the processing of "personal data" you provide to us is carried out in accordance with the terms and conditions stipulated in this privacy notice. By the foregoing, you express your "consent" to the processing of your personal data in accordance with the terms and conditions of this privacy notice.

Primary purposes
"GASMONSOFT" will process the "personal data" described in this privacy notice for the following primary purposes:

- Evaluate your request to hire our products and services
- Fulfill the contractual relationship for our products and services
- Manage, operate, and track the products and services requested or contracted with "GASMONSOFT"

- Perform collection management

- Respond to legal requirements from competent authorities
In the case of being a representative or attorney, "GASMONSOFT" may process your data to administer, operate, and manage compliance with the contract you sign as legal representative of a third party.
Secondary purposes
Also, if you do not object, "GASMONSOFT" may process your "personal data" to fulfill the secondary purposes indicated below:
- Send you advertising, promotional, and commercial prospecting information about our products and financial services, according to your profile
- Offer products and services from companies belonging to "GASMONSOFT"
- Send you invitations to participate in programs, activities, and events organized by "GASMONSOFT"

V. Limiting the use or disclosure of your personal data
If you wish that your personal data not be used from this moment on for the purposes described in the SECONDARY PURPOSES section, you may send an email to the following address: protecciondatospersonales@gasmonsoft.com, requesting non-consent to the use and processing of your "personal data" for all or some of the secondary purposes described in this privacy notice. We will promptly respond to your request and will stop using or processing your "personal data" for the secondary purposes you indicate.
VI. Data protection and "A.R.C.O. rights"
You have the right to access your "personal data" we hold and the details of its processing, as well as to rectify it if inaccurate or incomplete; cancel it when you consider it is not required for any of the purposes stated in this privacy notice; it is being used for non-consented purposes; the contractual or service relationship has ended; oppose its processing for specific purposes, as established in fractions I and II of article 26 of the Federal Law on Protection of Personal Data Held by Private Parties.
The mechanisms implemented for exercising these rights are through sending the respective request to the email protecciondatospersonales@gasmonsoft.com; said request may be submitted electronically or at any of the offices of GASMONSOFT, S.A. DE C.V. The official request form to exercise your "A.R.C.O. rights", which is the only one accepted, is the one provided by GASMONSOFT, S.A. DE C.V., and must contain the following information:
- The "holder's" name, address, and email address to communicate the response to your request.
- Indicate which right is to be exercised: Access, Rectification, Cancellation, or Opposition.
- A clear and precise description of the "personal data" for which you seek to exercise one of the rights.
- Copy of a valid official ID (voter ID, passport, military card) to prove your identity as the "holder". If the process is carried out by a representative, they must present a power of attorney signed by two witnesses with a copy of the "holder's" official ID.
The maximum response period for "GASMONSOFT" with the determination adopted on your request will be within twenty days counted from the date the "A.R.C.O. rights" request was received.
If your request is deemed appropriate, to make it effective, within fifteen days following the date the response is communicated.
The aforementioned deadlines may be extended once for the same period, provided the circumstances of the case justify it.
It is worth mentioning that the exercise of your "A.R.C.O. rights" is free; charges may only be made to recover reproduction, copying, or delivery costs, as established in article 34 of the Federal Law on Protection of Personal Data Held by Private Parties.
Likewise, at any time you may revoke the consent you have granted us for the processing of your "personal data", so that we stop using it. To do so, it is necessary that you submit a request and documents to prove your identity, under the same terms established for the exercise of your "A.R.C.O. rights".
VII. Data transfers
We also inform you that national or international transfers of your "personal data" may be carried out without the "client's" consent when:
- The transfer is made to controlled, subsidiary, or affiliated companies under the common control of "GASMONSOFT", or to a parent company or any company in the same group as "GASMONSOFT" that operates under the same internal processes and policies;
- The transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the "client", by "GASMONSOFT" and a third party;
- The transfer is necessary for the maintenance or fulfillment of a legal relationship between "GASMONSOFT" and the "client".
- The transfer is necessary or legally required to safeguard a public interest, or for the administration of justice; and
- The transfer is necessary for the recognition, exercise, or defense of a right in judicial proceedings.
The above, based on what is stated in article 36 of the Federal Law on Protection of Personal Data Held by Private Parties.
Should data transfer be necessary under a scenario not listed in article 36 of the Federal Law on Protection of Personal Data Held by Private Parties, you will be notified of the transfer and the reasons for it. If you do not express disagreement, it will be taken as tacit acceptance.

We reserve the right to make modifications or updates to this privacy notice at any time, to address legislative developments, internal policies, or new requirements for the provision or offering of our services.
